You must read this Terms of Use before you register
Use of the YouSwop website is governed by the terms and conditions laid out below, by agreeing to these terms and conditions you agree that you are legally bound by these. If you are a business entity you are by agreeing to this User Agreement confirming you have the authority to bind that business to this agreement.
This agreement shall prevail over any previous agreements or arrangements, written or oral, between YouSwop (its owners, employees or agents) and you. This agreement is not intended to limit any rights you may have as a consumer under local law or other statutory rights.
1. Membership
1.2. Eligability
To be eligible to use this site and engage in exchange activity you must be a registered user whose membership has not been suspended or terminated. You can become a member by registering; to register you must be 18 years of age or above or if under 18 use this service in conjunction with and under the supervision of a parent or guardian.
1.3. User ID
Exchange activity is performed under a User ID and password supplied by you when you have completed the registration process. You are solely responsible for all activity under that User ID and password and should keep this information safe; do not to disclose this information to any other person.
2. Role of YouSwop
2.2. YouSwop is a venue
YouSwop is a venue where registered users may engage in the exchange of views and goods between themselves. You are solely responsible for the accuracy of listings, quality of goods, completion of transactions and the legality of the items you exchange.
2.3. Disputes between users
YouSwop does not get contractually involved in exchanges any disputes between users must be resolved between the seller and buyer. For your protection, we recommend a recorded delivery service be used for exchanges.
In the event that you pursue any right, claim or action against any other user you agree to pursue such rights, claims or actions without our involvement in anyway. Additionally in such an event you agree not to make any claims of liability, damages, losses, costs, or expenses, against YouSwop (or its owners, employees or agents).
3. Selling and Listing
You agree you will not concurrently list for sale the same item on any other media and agree not to trade in illegal goods. Items listed that do not sell will be automatically de-listed after the selected listing period. Any item listed or offered as an exchange must be legal within the governing state, users are solely responsible for ensuring listings and non-cash offers are legal.
3.2. Information
The user is solely responsible for the accuracy of the information they post on any listing and for any information they provide to complete a transaction. Information posted by users should not cause offence or be malicious, harmful, obscene, or be deceptive. By using this site you agree YouSwop is not responsible for the accuracy of information in listings or for omissions in information. We strongly recommend you apply common sense and caution in transactions.
3.3. Ownership of items for exchange
You must be the legal owner of any item you list or exchange on the site and you agree not to deal in counterfeit or stolen items.
3.4. Exchanges
Buyer
As a buyer you may offer an item for exchange. By agreeing to this User Agreement you acknowledge that if a seller accepts your exchange offer you are legally obliged to complete the transaction and must exchange or make payment.
By making an offer to any listing you agree to the conditions of sale and accept full responsibility for assessing the fit for purpose of any purchase.
Seller
As a seller you acknowledge that you will not be able to cancel a listing once you have submitted this to the site. You agree to complete any transaction unless the buyer fails to meet the conditions of sale.
You must not contact buyers in an attempt to offer the same or similar items to any listing on the site.
4. Integrity of the site
The site may not be used for any fraudulent activity, YouSwop may at any time terminate your membership if we believe you are engaging in or are about to engage in fraud.
A user rating system is provided as an aid to the seller and buyer in a transaction they are about to undertake, you must not in any way undermine the integrity of the rating system. Users who have earned a one star rating may be suspended from trading on the YouSwop site.
As a registered member you agree not to trade in illegal goods or any items found in the Prohibited Item List.
5. Privacy
5.2. Your information
In to order to register, buy, sell or exchange goods you will need to supply user information about yourself and the goods you wish to exchange. You acknowledge that you grant YouSwop a non-exclusive, world-wide, perpetual, irrevocable, royalty free licence to use any information you provide to the site (including graphics, descriptions, bids, feedback, opinion, copyright, trade marks).
By accepting this User Agreement you agree that information you provide will not be false or misleading; will not be obscene or indecent; will not be offensive, threatening, abusive, defamatory, or in breach of copyright, confidence, privacy or any other rights; also will not infringe any copyright, patent, trade mark, trade secret or other proprietary rights or rights of publicity or privacy; and will not be in breach of any applicable laws or regulations.
YouSwop may from time to time communicate with you via e-mail, post or phone with information and services that we believe may be of interest and value to you. By agreeing to this User Agreement you agree to receive such communication unless you indicate that you do not wish to.
5.3. Other users Information
When a seller accepts your exchange offer or in an auction style listing your bid, both seller and buyer are legally obliged to complete the transaction.
To enable the completion of the transaction YouSwop will provide the seller with the buyers contact information and provide the buyer with the sellers contact information.
By accepting this User Agreement, you agree that:-
1) You will only use contact information to complete a transaction between you and the other party.
2) You will not use another users information for any other commercial purpose (including all forms of unsolicited communications) or research purposes without the express permission of YouSwop and the written consent of the user. Where such permission is given you solely will be responsible for using such information in accordance with the laws and regulations applicable.
5.4. Protecting the service
YouSwop is a service for the benefit of the user community, to ensure the continuity of this service users must not damage or interfere with its operation or reputation. By agreeing to this User Agreement you agree that you will not :-
1) Cause YouSwop, our ISP's or our suppliers any financial or reputation loss through any action(s) you take on the site.
2) Pass onto YouSwop, its owners, employees, partners or suppliers any information that is infected by any type of computer virus that may or may not interfere with the normal operation of the website or the computer equipment of its partners or that of other users.
3) Deploy any type of technology or information on the site that disrupts normal operation or damages the site in anyway.
4) Overload or attempt to overload the service in any way.
5) Use any type of technology (including without limitation spiders, screen scrapers, bots) that intercepts or accesses YouSwop business information or system information or the information of any user for any purpose whatsoever without the express permission of YouSwop.
6. Warranties
YouSwop services are provided on an "as is" basis we do not guarantee uninterrupted , continuous, or secure access to our services. By agreeing to this User Agreement you acknowledge that YouSwop does not offer any explicit or implied warranty as to the availability or performance of the site or any of its services.
7. Liability
YouSwop (including its owners, employees or agents) will not be liable for any economic loss (including loss of revenues, profits, business or property), any loss of goodwill or reputation, any loss of data, or any special, indirect or consequential damages (however arising, including negligence) arising out of or in connection with this User Agreement.
YouSwop (including our owners, employees or agents) have no liability of any sort (including negligence) for the acts or omissions made by providers of infrastructure services or for faults in or failures of their service.
8. Indemnity
You agree to indemnify YouSwop (it owners, employees and agents) harmless from any claim, demand or expense (including legal fees) made by any third party due to or arising out of your breach of this User Agreement or your violation of any law or the rights of a third party.
9. Rights of Third Parties
This agreement is between YouSwop and the user, a person who is not a party to this has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any part of it.
10. Copyrights
You agree that you will not copy, reproduce, modify, distribute or publicly display any content other than your own personal information from the Site without prior written permission of YouSwop and where applicable that of its suppliers, or partners
11. Sale of business
In the event YouSwop is sold to or merged with another business your details may be disclosed to parties involved in this process and will be passed on to the new owners of the business.
12. Governing Law
All transactions carried out on the site shall be governed by and interpreted in accordance with Singapore law and the Singapore courts shall have exclusive jurisdiction in relation thereto.
13. Breach of Agreement
YouSwop may without limitation take appropriate action (including suspension, termination of your registration, removal of your listings and a refuse any further services to you) where we believe you have breached this user agreement or may breach this agreement by the actions you take. A failure on our part to act in a particular breach of this agreement does not waive our right to act in any subsequent breach(s). In the interest of users, YouSwop terms and condition in this User Agreement will kept upto date so that they remain effective and enforceable. In the event that any part of this User Agreement becomes unenforceable the enforceability of any other part of this agreement will not be affected.
14. Prohibited and Restricted Items
As a YouSwop seller, you are responsible to make sure that Swopping an item is legal in the eyes of the law.
Before you list your item, you need to find out if your item is allowed on YouSwop and if the type of item is subject to certain restrictions to avoid potential issues with your listing.
Violations of these policies may result in any or all of the below actions:
- Cancellation of Listings
- Suspension of Accounts
- Demotion of Swopper Status
Understanding the rules about prohibited and restricted items
Policies about listing items are often based on country and state laws. However, many restrictions may involve the sale of dangerous or sensitive items and are not necessarily prohibited by law. The limitations are the result of input by numerous stakeholders, including the Community as whole.
When Swop Selling across borders, be aware of international trading and import restrictions. Certain items may be legal in your country, but may be illegal elsewhere.
Just because a particular type of item is listed below, it does not mean that it is completely prohibited.
Note: Examples are designed to help explain the policy and should not be viewed as an exhaustive list.
It is also important to review the Rules about Intellectual Property in your respective Country to check if your type of item has additional restrictions that would affect your listing.
